These Kanza AI Terms of use apply to your use of our Kanza Health Intelligence Platform and Kanza AI’s other services for individuals, along with any associated software applications and websites. Use of our services for businesses and developers are governed by the Business Terms of use. These Terms form an agreement between you and Kanza AI, Inc., a Delaware company, and they include our Service Terms and important provisions for resolving disputes through arbitration. By using our Services, you agree to these Terms.
By accessing, registering for, or using Kanza AI, you agree to be bound by these Terms.

Nature of the Platform
Kanza AI is a Health Intelligence Platform that processes data to generate insights based on proprietary protocols, research, and datasets from leading medical experts and institutions. We help you visualize and understand your health, energy, and wellness patterns through our proprietary "Wheel of Health."

Information Only: Kanza AI is an intelligence platform, not a doctor, clinician, or medical device.
No Doctor-Patient Relationship: Use of the Services does not create a physician-patient relationship between you and Kanza AI.
Consult a Professional: You should never disregard professional medical advice or delay in seeking it because of something you have read on Kanza. If you think you have a medical emergency, call your doctor or emergency services immediately.
AI & Novel Technology Disclaimer
You acknowledge that Kanza AI uses generative artificial intelligence, which is a novel and evolving technology.
Accuracy Not Guaranteed: AI systems can produce "hallucinations" (incorrect or misleading information). Kanza may occasionally generate insights that are factually incorrect or not applicable to your specific situation.
User Verification: You agree to verify any health insights with a qualified professional before taking action. You assume all risk for decisions made based on Kanza’s output.
Third-Party Integrations (Wearables)
Authorization
Our Service integrates with third-party platforms such as Apple Health, Oura, and WHOOP to provide personalized insights. By connecting these accounts, you grant Kanza AI permission to access and analyze your biometric data (e.g., sleep, HRV, movement).
Pass-Through Liability
We are not responsible for the accuracy or availability of data provided by third parties. If your Oura Ring, WHOOP strap, or Apple Watch records inaccurate data, Kanza’s analysis may reflect those inaccuracies. Your use of those devices is subject to their respective terms of service.
Data Privacy Commitment
To ensure compliance with our partners (including Apple, Oura, and WHOOP) and to protect your privacy:
We do not sell your health data: We will not sell, rent, or lease your biometric data to advertising platforms, data brokers, or information resellers.
Usage Limitation: We use your synced health data solely to provide you with health management and fitness insights within the Kanza AI application.
Intellectual Property & Ownership
Kanza AI Ownership:
We own all rights, title, and interest in the Kanza AI platform, including the "Wheel of Health" framework, our software code, UI/UX designs, and proprietary AI models.
Expert & Institutional Ownership:
You acknowledge that specific datasets, health protocols, and knowledge bases used within the Service may be owned by our experts, institutions and other partners.
Expert Retention:
These experts, institutions and partners retain full ownership of their respective input content, datasets, and protocols.
No Transfer of Rights:
Kanza AI utilizes this material under license. You do not acquire any ownership rights to this expert material by using the Service.
User Content
You retain ownership of the personal health data and text you input or sync to the Service ("User Content"). You grant Kanza AI a worldwide, non-exclusive, royalty-free license to use, process, and analyze your User Content to provide the Services to you and to improve our Health Intelligence. If you do not want us to use your data to improve our models, you can opt out in your user settings.
Acceptable Use Policy
To protect our platform and our expert partners, you agree NOT to:
- Reverse Engineer: Decompile, disassemble, or reverse engineer any aspect of Kanza AI or attempt to discover the source code, underlying expert protocols, or model weights.
- Scrape or Extract: Use any automated program, "bot," "spider," or "scraper" to access Kanza AI or extract data, prompts, or model outputs.
- Misuse for Medical Harm:Use the Service to prescribe medication, diagnose conditions for others, or provide medical advice.
- Bypass Restrictions:Attempt to circumvent any content filtering, security measures, or rate limits we have placed on the Service.
Subscriptions & Billing
Auto-Renewal: If you purchase a subscription, it will automatically renew at the end of each billing period at the then-current rate.
Cancellation: You may cancel your subscription at any time via your account settings. Cancellation will take effect at the end of the current billing cycle.
No Refunds: Except where required by law, payments are non-refundable.
Indemnification
You agree to defend, indemnify, and hold harmless Kanza AI, its affiliates, officers, directors, employees, and expert partners/licensors from and against any claims, damages, obligations, losses, liabilities, costs, or debt (including attorney's fees) arising from:
- Your use of and access to the Service.
- Your violation of any term of these Terms.
- Your violation of any third-party right, including any intellectual property or privacy right of Apple, Oura, WHOOP, or others.

OUR SERVICES ARE PROVIDED “AS IS.” EXCEPT TO THE EXTENT PROHIBITED BY LAW, WE AND OUR AFFILIATES AND LICENSORS MAKE NO WARRANTIES (EXPRESS, IMPLIED, STATUTORY OR OTHERWISE) WITH RESPECT TO THE SERVICES, AND DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, NON-INFRINGEMENT, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF ANY COURSE OF DEALING OR TRADE USAGE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ACCURATE OR ERROR FREE, OR THAT ANY CONTENT WILL BE SECURE OR NOT LOST OR ALTERED.
YOU ACCEPT AND AGREE THAT ANY USE OF OUTPUTS FROM OUR SERVICE IS AT YOUR SOLE RISK AND YOU WILL NOT RELY ON OUTPUT AS A SOLE SOURCE OF TRUTH OR FACTUAL INFORMATION, OR AS A SUBSTITUTE FOR PROFESSIONAL ADVICE.
Limitation of Liability
NEITHER WE NOR ANY OF OUR AFFILIATES OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA OR OTHER LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE THAT GAVE RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE LIABILITY AROSE OR ONE HUNDRED DOLLARS ($100). THE LIMITATIONS IN THIS SECTION APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

KANZA AI’S AFFILIATES, SUPPLIERS, LICENSORS, AND DISTRIBUTORS ARE INTENDED THIRD PARTY BENEFICIARIES OF THIS SECTION.
Dispute Resolution (Binding Arbitration)

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

No Jury: You waive your right to a trial by jury.
Class Action Waiver:
You and Kanza AI agree that each may bring claims against the other only in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.
Modifications to Terms
We may modify these Terms at any time. If we make material changes, we will provide notice (e.g., via email or in-app notification). Your continued use of the Service after the effective date constitutes your acceptance of the amended Terms.
